Terms of Service

1. Acceptance of Terms

By accessing or using CreativeLens ("Service") at creativelens.polsia.app, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

CreativeLens is operated by Polsia Inc. We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

CreativeLens is a creative intelligence platform that provides a curated gallery of AI-generated images, prompt libraries, performance scoring tools, and a Studio for AI image prompt optimisation. Users can browse prompts, submit community images, and access the API.

3. User Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorised use at hello@creativelens.polsia.app.

4. Community Submissions

4.1 What You Submit

When you submit an image and prompt to our gallery, you represent and warrant that:

  • You have the right to submit the content and grant the licence described below.
  • The submission does not infringe any third-party intellectual property, privacy, or other rights.
  • The image was generated using an AI tool and the prompt is the one used to generate it.
  • The content complies with our Acceptable Use Policy (Section 5).

4.2 Licence Grant

By submitting content, you grant CreativeLens a non-exclusive, worldwide, royalty-free, sublicensable licence to display, reproduce, distribute, and promote the submitted image and prompt as part of our gallery and marketing materials. You retain ownership of your content.

4.3 AI-Generated Content Disclaimer

CreativeLens is a curation and discovery platform, not an AI provider. Images in our gallery were created by community members using third-party AI tools (Midjourney, DALL-E, Stable Diffusion, Flux, etc.). We do not control those tools and are not responsible for their outputs. Questions about AI-generated content ownership should be directed to the respective AI provider's terms of service.

5. Acceptable Use Policy

You may not use the Service to submit, post, or transmit content that:

  • Is sexually explicit, NSFW, or depicts minors in any sexual context
  • Depicts real, identifiable people without their consent
  • Promotes hatred, violence, or discrimination
  • Infringes copyright, trademark, or other intellectual property rights
  • Is spam, misleading, or fraudulent
  • Violates any applicable law or regulation

We reserve the right to remove any content and suspend or terminate accounts that violate this policy.

6. Intellectual Property

The CreativeLens brand, UI, platform code, prompt curation methodology, performance scoring system, and all original content created by us are owned by Polsia Inc. and protected by copyright and other laws. You may not copy, reproduce, or distribute our proprietary materials without written permission.

7. API Access

API access is subject to rate limits and fair use. We reserve the right to throttle or revoke API access for accounts that abuse the API or use it in ways that degrade the Service for others. Commercial API usage requires an active paid plan.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE CONTENT WILL BE ACCURATE OR COMPLETE.

AI-generated images displayed on this platform may be subject to disputes regarding copyright ownership, as AI-generated content law is evolving. We make no representations about the legal status of any specific AI-generated image.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLSIA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR CONTENT SUBMITTED BY USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.
